A flying freehold is the term for a property on a freehold tenure where part of the building sits above part of another property. Often this may be with older properties converted into maisonettes. Your living room or bathroom for example may extend over someone else's kitchen.

This is non standard as it means in the event that there was a roof collapse or similar damage to an area covering both properties there would be no definite rule as to who would be liable for the repair. There are other complications which can arise with a flying freehold property but this is just one example.

For this reason many lenders consider Flying Freehold Mortgages to be higher risk lending, and this in turn makes them less straightforward to sell. Most high street banks will accept these properties but there are subtle differences in the lenders criteria around Flying Freehold Mortgages which mean that in most cases mortgage advice would be beneficial.
